The Gold Montetization Scheme 2015

The Gold Monetization Schemes announced in the Union budget 2015-16 were launched by the Prime Minister on November 05, 2015. The three schemes launched under this program aim to get back the unutilized gold of households and individuals into the Indian economy.  The long-term objective is to reduce the country’s reliance on the import of gold to meet domestic demand, thus improving India’s current account deficit.

Gold Monetization Scheme:

As the name suggests, the Gold Monetization Scheme aims to encourage people to earn interest on their metal accounts, by keeping their gold safe in the custody of a bank.

So, what actually happens is:

  1. If you are a customer and take your gold to a bank, then the metal will first be tested for quantity and quality. Once the purity is determined, the exact amount of gold will be credited to your metal account and you will be paid interest on the same. The bank in turn, will lend this physical gold to a jeweller and charge an interest slightly above the one offered to you.
  2. Testing will be done at those centres which will meet the criteria laid down by Bureau of Indian standards (BIS).
  3. At the time of maturity, the compounded interest will be added to your initial balance in the metal account. Example: If you had deposited 100gms of gold, and were paid 1% interest on it, then at the end of one year, you will have a metal balance of 101 grams.
  4. The minimum tenure of deposit will be one year with the min. weight being 30 grams, to encourage small depositors.
  5. The ROI has been fixed at 2.25% to 2.50%.
  6. Gold can be offered in any form: bullion or jewellery.
  7. At the time of redemption too, you will have the option of taking back gold or cash but, you will have to state your choice at the time of deposit.
  • Sovereign Gold Bond Scheme:

The second scheme is the Sovereign Gold Bond Scheme under which people who buy gold for investment purposes will be encouraged to invest in this gold bond instead of buying the physical metal.

This is how you can do that:

  1. In this gold scheme, as an investor you can invest your money in gold bonds, the price of which will be linked to the price of gold in the actual market.
  2. The bonds will be issued by the Reserve Bank of India on behalf of the Government of India.
  3. The bonds can be used as collateral against loans and can also be sold or traded on stocks exchanges.
  4. They will be available both in paper and demat format.
  5. Returns from these bonds will be based on the ongoing market price of gold at the time of redemption.
  6. The tenure of the bond will be 8 years, with an exit option available in the 5th, 6th and 7th
  7. The bonds will be issued on payment of rupees and the min. quantity that can be purchased is 2 grams with an upper limit of 500 grams.

Gold Coin and Bullion Scheme (NATIONAL COIN):

Under the Gold Coin and Bullion Scheme, the government will issue gold coins, the first ever national coin, which will have the Ashok Chakra engraved on them. The coins will initially be available in weights of 5 and 10 grams to be followed by 20 gram bars, later on.

To start with, government will roll out

  • 15,000 coins of 5 gram
  • 20,000 coins of 10 grams
  • 3,750 bars of 20 grams

The coins will have advanced anti-counterfeit features and tamper proof packaging that will aid easy re-cycling.

What do you think are the benefits of these Gold Schemes:

  1. The main benefit of all the three gold schemes is the availability of alternate routes of investment, demand for actual gold will drop significantly and hence, there will no need to import gold in the long run.
  2. Once the gold imports drop, export deficit and current account deficit will also decrease.
  3. The mobilized gold will also supplement RBI’s gold reserves and will help in reducing the government’s borrowing cost.
  4. The risk of gold price changes will be borne by a Gold Reserve Fund (GRF) that is being created. The benefit to the government will be in terms of reduction in the borrowing cost which it will transfer to the GRF.

Challeges ahead:

  1. Mobilizing gold out of Indian household will not be an easy task, especially if it is in jewellery form. Under the GMS, depositor has to declare at the time of deposit, the form in which he/she would like to redeem his/her deposit and, even if a person choses gold it will be in the form of bars, and not the same jewellery.
  2. The second challenge is that this scheme might even have a counter effect where people might be encouraged to import cheaper gold from outside and deposit it in the banks to earn attractive interest, but the chances are bleak.

To conclude, the gold monetization scheme is definitely a good initiative by the finance ministry under the Government of India to mobilize the gold lying idle in households, trusts and various institutions and put it to productive use, but the success depends on people’s participation and the way the scheme progresses. Let’s see how our people welcome this scheme.

Am I late for the FALL (Aug/Sept) admissions 2016, in the US? How can I hasten the process?

It is early December now and you can still catch up with the fall admissions of 2016. Yes, you have missed the first round deadlines for most of the prestigious universities, but thankfully they have multiple rounds of deadlines for acceptance of the application forms.

  • Universities overseas have Round 1, Round 2, Round 3 and a few have Round 4 of application.
  • It is a myth that applying in round 1 increases the chance of one’s acceptance.
  • If you are not ready for Round 1 you can apply for further rounds (especially round 2).
  • Far too many candidates believe that the number of places at MBA programs is limited and that applying in a later round might mean that those places are already taken. This may be true for later rounds (Round 3 and later at top schools) but is not much of an issue between Round 1 and Round 2.
  • Of course applying in earlier rounds enhances any possibility of scholarships.

Are the IVY leagues still a possibility?

The National Judicial Appointments Commission (NJAC) is a constitutional body proposed to replace the present Collegium system of appointing judges. The NJAC was established by amending the Constitution (Ninety-Ninth Amendment) Act, 2014. Both Bills were ratified by 16 of the State legislatures and the President gave his assent on December 31, 2014. The NJAC Act and the Constitutional Amendment Act came into force from April 13, 2015.

Who will be in the NJAC?

NJAC comprise of six dignitaries ; Chief Justice of India, two most senior judges of the SC, the Law Minister, and two Eminent Persons. Eminent Persons are nominated for a three-year term by a committee consisting of the (Chief Justice, the Prime Minister, and the Leader of the Opposition in the Lok Sabha), and are not eligible for re-nomination. It is different from the earlier collegium system which comprised the Chief Justice of India and Forum of four senior-most judges of the Supreme Court

NJAC has been the most debated move by the Central Government.

Amicus reviews NJAC with Legal Faculties of LST pan India. This year we do expect CLAT to have some questions from the same. So it is important for the law aspirant to know the in and out of this system. I will now present a few opinions and try to answer a few questions.

Ashish Singh , LST Anchor , UP East Region takes a balanced view NJAC and after researching from the political angle gives a very detailed analysis. He quotes ‘In a discussion in the Rajya Sabha on the Liberhan Commission report, former law minister and then leader of the Opposition, Arun Jaitley, expressed his view that there are two types of judges – one who knows law and second who knows the law minister’. This opinion strengthens the allegation that the influence of the executive in the appointment of judges cannot be ruled out unless a judicial commission is formed. On the same occasion, Jaitley also said the clamour for post-retirement jobs is also adversely affecting the impartiality of judges of the higher judiciary. The NJAC act was passed unanimously on the demand of noted jurists and learned personalities in order to make the process of judicial appointment transparent and for dealing with corruption in an effective way. Surprisingly, the five-judge bench not only struck down the act but also brought back the collegium system that has so many discrepancies. It is necessary to make a brief list of different enactments for the appointment of judges.

He further adds ‘It was with the objective of improving the existing system that the previous government embarked upon a series of reforms during the second half of its tenure. Three bills were prepared focussing on different aspects of the judiciary.’ The completion of this endeavour was left to the good offices of BJP once it came to power. However, with the SC striking down the constitutional amendment that would have established the NJAC, we have taken a significant step back. While the SC’s order is respected, it is now time to introspect and determine what could have been done for a different outcome. We can analyse it in three respects

First, the approach adopted by the BJP government and those in charge of navigating the law was not one of conciliation and compromise, but of confrontation. Perhaps emboldened by the strength of their numbers in the Lok Sabha, the government did not feel the need to build a broader consensus, hoping that legislative majority alone could be an answer to unilateral decision-making. In theory it could have been. In practice, it cannot. It was also not entirely graceful to wash dirty laundry in public. There was, in retrospect, no need to name and shame judges. Diplomacy is an essential part of manoeuvring any law but it becomes doubly so when you have to convince a skeptical judiciary that it’s in their best interests.

Second, the BJP’s amendments, though few, made substantial changes which had an impact on the way the law came to be viewed by the apex court. They systematically altered the carefully crafted balance that had been achieved with the draft prepared by the previous government. Veto powers were given to the two members, meaning that it would become possible to game the system if the two decided to collude (the judgment draws attention to the potential for abuse). Hard-coding the constitution of the committee into the amendment instead of leaving it open to easy amendment could also have been examined in greater detail. Many voices have spoken out about better defining the criteria for the posts of eminent personalities. Greater engagement with the judiciary over the last year-and-a-half could have helped address these concerns.

Third, the BJP government chose to disregard the other pillars of reform and chose almost exclusively to focus on the law regarding judicial appointments. The other two bills, which related to judges inquiry and judicial accountability, were allowed to languish. These were important parts of a nuanced answer to a complex problem. The bill on judicial accountability particularly would have ensured greater transparency in decision-making by holding judges accountable to a statutory standard. The inquiry bill, on the other hand, provided a forum governed by the higher judiciary itself while establishing a transparent institutional mechanism for speedy redressal of complaints against judicial misconduct

Deepu Krishna, our Law program head supports the NJAC by asserting that, around the world the selection of Judicial officers have always evolved through various improvements of processes and the stress always has been to keep the faith of people on Judiciary alive. He is supportive of the contention of many senior advocates and jurist in the country that post collegium the Nation has not witnessed one inspiring Chief Justice of India. He even felt it personally during his period of litigation that this country was robbed off its chance to have its first woman chief justice of India in form of Justice Ruma Pal who was denied the coveted seat because of her alleged less allegiance to the “collegium”. Legally Deepu Krishna feels NJAC should have been at least made operational for some time to factually realise all the apprehensions about infringement of independence of Judiciary. This could have been true or false, but unless proven by practice it was premature on part of Judiciary to contend that this was Legislative breach of separation of power. But this prompt response of Judiciary does raise suspicion. The Separation of power stresses specifically that legislative and administrative power vests with Legislature and Judicial power vests with Judiciary. The constitution of NJAC on the face of it does not interfere anywhere with the judicial functions of the Judiciary. If put to practice we would have surely seen, experienced the flaws and then questioned it like the Judicial review powers under 9th schedule.

While Judiciary and Legislature are fighting it out the attorney General of India has recently remarked that the Government shall come up with a New act and the Judiciary has reinstated the Collegium, To summarise we shall pull up Ashish Singhâ’s closing remarks ‘For a year-and-a- half, legislative success has eluded the government. Every morning brings with itself a new start to learn something new. The 1st of November happened to be a turning point in my Sunday routine, the start of the TYE 2015. Eagerly sitting on those not so comfortable benches with eyes gazing at the door, who will be coming and how will the TYE begin?

Being told by many that you’ll learn a lot but being not so convinced of how 4 hours on Sunday could teach me so much?
But after attending the first session my thoughts changed. The first session in itself was a totally new experience. The most important thing I learnt from the session was that an entrepreneur does not dream to become a billionaire but rather aims to work hard and in this process earn a buck. The second thing I learnt was that aspirations are what lead you to success. The last but not the least was that the best business is the one that caters to the needs of the society and evolves with time.

An entrepreneur enters the market with an aim to achieve something and not to become a billionaire, his main focus lies on the fact that he has to work hard to make his way through. All entrepreneurs are not people with millions in their bank accounts but people with billions of ideas in their mind. They aspire to revolutionize society, to be the trendsetters and achieve their goal. Bill Gates did not aspire to become the richest man in the world, but he dropped out of Harvard University to bring about a change in society which led him to becoming a billionaire. Becoming a rich person is the outcome of your hard work, not the initial aim of any entrepreneur.

The aspirations of an individual are the driving force of his life and career which make him thrive for excellence. A man whose aspirations are higher than any other force, he is bound to achieve success. The lack of resources like capital, machinery, land etc do not affect him even a tat bit because high aspirants pave their own way through, their aspirations pave a path where everything falls in place and their dreams manifest into reality.

Whether it is Facebook or Flipkart or any multimillion firm, all have one thing in common, they identified the needs of the society. The most successful entrepreneurs are those who understand the needs of the society and cater to them. Mark Zuckerberg identified the lack of a common social platform and built Facebook. No doubt today Facebook is widely used and is the best in its field. Or it was Flipkart who identified the lack of cash on delivery system of payment and introduced it, leading them to become the biggest e-commerce business in the nation.

Learning is a process and not an outcome and the most successful entrepreneur is one who learns in the process and not at the end of the process.

Statistics have shown that more than half of India’s population dream to become successful entrepreneurs and businessmen. The problem is that we only aim at earning a lot and not understanding the troubles and risks that any new firm or an entrepreneur has to go through before achieving success.

Mark Zuckerberg said that the biggest problem with new and young entrepreneurs especially is that we only aim at earning a lot and not thinking of ways of how to change the world because in this economy a creative idea is the one that survives and prospers.

Being a student who is about to give CBSE Class XII examination, it is necessary for me to think about my future. I would love to be one of the world’s best entrepreneurs but I also know that it is not that easily said and just done. I have read about the troubles successful entrepreneurs had to go through and understood the necessity of courage and faith one must have on his/her idea.

It’s impossible to start and run a business without having the required knowledge. I joined the TYE program so that I can grasp as much as I can about business knowledge, what all could help mould my imagination, understand what all troubles entrepreneurs have to face and how to overcome them.

The first day was quite an excellent one and it was a very interactive class. We were given much insightful knowledge by Satya sir and GP sir.

They told us their perspective on business and their business experience “ how they decided to become entrepreneurs, how they came up with their business ideas and how they overcame the obstacles that they faced.

GP sir showed us that it is never late to start one’s own business.

Satya sir held a very interactive class and conducted a very exciting activity.

The class helped me learn more about what business actually is and to keep our eyes open at all times because new and creative ideas can be around us. All we have to do is interpret and understand it.

I learned that if I have an idea I must ensure its validity and believe in it. Rocks will be thrown at me but I must believe in my idea. I understand that I have to be courageous and that I’ll face many obstacles but I should never stand down. Every idea has its demerits and risks which cannot be avoided. Risk is something that never leaves a business. It has to be faced and dealt with.

More the risk, more will be the profit.

It truly was an admirable class and I am looking forward for the next class and meet many more professionals to understand the various sides of business.
